I hereby grant to photographer Kira Jarmer, Ell Photography, and Assigns, together “Hosts”:
The absolute and irrevocable right and unrestricted permission to take photographs or video that may contain my likeness, as well as my image, (the “Content”); To take, record, publish or obtain testimonials or other statements from me (the "Statements"); To use, copy, modify, adapt, distribute, publish, display, exhibit and otherwise use, either in whole or in part, the Content and/or Statements for commercial and business purposes in one or more film, videotape, or multimedia productions; and/or on Hosts’ website and/or in any artistic, educational, advertising, marketing and promotional materials; To license Content in any media for any purpose and may be combined with other images, text, graphics, film, audio, audio-visual works and may be cropped, altered or modified.
I understand and agree that the Content may or may not contain attributions specifically identifying me or any of my property. Hosts shall have the right to modify, reproduce, display distribute, or otherwise disseminate the Content and/or Statements, in whole or in part, provided that any modifications or alterations made to such Content and/or Statements do not significantly alter or misrepresent the original content.
I hereby waive any right that I may have to inspect or approve the finished products or the advertising copy or printed matter that may be used in connection therewith or the use to which it may be applied.
I hereby release and discharge, Hosts, its employees, agents, successors, licensees and assigns from any and all claims I might have in connection with Hosts’ use, display, distribution, dissemination or exploitation of the Content and/or Statements, including, but not limited to, any claims for defamation; violation of any moral or artist rights; and/or any right of privacy or publicity.
I hereby release, discharge and agree to save harmless “Hosts”, its legal representatives or assigns and all persons acting under its permission or authority, from any liability in connection with the use of the photographs, video and/or film as aforesaid or by virtue of any alteration, processing or use thereof in composite form, whether intentional or otherwise, as well as any publication thereof.
I agree that the photographs, the transparencies thereof, video and/or film, and the rights to copyright the same, shall be the sole property of the Photographer and Assigns, with full right of lawful disposition in any manner.
I hereby release from liability and to indemnify and hold harmless Hosts, and any of its employees or agents representing or related to event. This release is for any and all liability for personal injuries (including death) and property losses or damage occasioned by, or in connection with any activity or accommodations for this event. The undersigned further agrees to abide by all the rules and regulations promulgated by Hosts, Organizations and Locations where event will occur, and city ordinances.
I will be legally liable and responsible for personal injury, property damage, vandalism, theft, or false reporting that I cause by my acts or omissions, regardless of culpability. In the case of property damage, theft, and vandalism to Hosts’ assets, accidental or otherwise, I agree to pay the full retail value plus any tax to have damaged items replaced with new items of the same or better model.
I further acknowledge that I will receive no compensation from Hosts other than any goodwill and publicity that I may receive relating to the publication, distribution or other use of the Content and/or Statements as set forth in this Release. I acknowledge that Hosts are the sole and exclusive owner of all right, title, and interest in all copyrights, trademark rights, and any and all other intellectual property rights, worldwide, in the Content and/or Statements and the individual components thereof and I shall take no action to challenge or object to the validity of such rights or Hosts’ ownership or registration thereof. This document represents the entire agreement between Hosts and myself with respect to this subject matter. This agreement and all actions related to it shall be governed by the laws of the State of New Mexico (excluding any conflicts of laws principles that would require the application of the laws of a different state).
